Terms and Conditions for the Comfitex “Makeover” Promotion
1. The Promoter of the Promotion is NSP Unsgaard (Pty) Ltd, a subsidiary of Lion Match Company (Pty) Ltd.
2. The name of the Promotion is Comfitex “Makeover” Promotion.
3. The Promotion
a. Any person participating in this promotion (“Promotion”) does so on acceptance of these terms and conditions (“Terms and Conditions”).
b. NSP Unsgaard (Pty) Ltd and its subsidiaries are collectively referred to as the “Promoters” in respect of the Promotion for purposes of these Terms and Conditions.
c. The Promotion will run from 17 May 2021 and ends 17 July 2021. No late entries will be accepted.
d. This Promotion is only open to all residents of South Africa who are 18 years and older.
e. No director, employee, agent or consultant of Lion Match Company (Pty) Ltd and its subsidiaries including NSP Unsgaard (Pty) Ltd, or their spouses, life partners, business partners or immediate family members, or the supplier of goods and services in connection with this competition may participate in this competition.
4. The Entry Mechanism
a. To enter, participants must buy any pack of Comfitex Pantyliners from any participating store during the competition period.
b. Participants must then dial *120*44400# to enter and when prompted, enter the last 4 digits of the product barcode.
c. Only one entry per purchase.
d. Entries are limited to 5 entries per phone number per month. If a participant would like to enter more than 5 times in 1 month, they must call Roxy on 031 492 3290 to get their phone number unlocked for further entries. This will only be done upon proof of more than 5 legitimate purchases.
e. USSD line cost R0.60 per 60 seconds.
f. Participants must retain till slips as proof of purchase.
g. The winners will be selected by means of a random draw.
h. Entries which are unclear, illegible or contain errors will be declared invalid.
i. No entries by post or any other form will be accepted.
j. Participants who entered any Lion Match Company competition and have won any prizes in the last 3 (three) months, from the last day of the competition, will not be eligible to win again and will be disqualified from the competition.
k. The winners must identify themselves by means of an ID document or other acceptable identification means and confirm receipt of their prize, which identification and confirmation shall be to the satisfaction of the promoter. Any prize not taken up for any reason within one month of the close of the competition will be forfeited.
l. By entering this competition all participants accept and agree to abide by these rules.
m. The judges’ decision will be final, and binding and no correspondence will be entered into.
5. Competition Prizes
a. Comfitex makeover competition winners will be as follows:
• Main Prizes:
- 3 x consumers stand a chance to each win Online courses up to the value of R12 000 and Makeup hampers to the value of R1 200.
• The Runner up winners:
- 12 x consumers to win makeup hampers to the value of R1 200 each.
b. The Promotion closes at 23:59 on 17 July 2021.
c. Competition draw will take place on the 30 July 2021.
d. The prizes are non-transferable, non-refundable and cannot be redeemed for cash regardless of the estimated monetary or other value of the prize.
e. Prize winners shall be notified via telephone and/or email. Participants must therefore ensure that the Promoters have their correct, updated details.
f. If the winner / winners cannot be contacted following all reasonable attempts to do so, the promoter reserves the right to select another winner in substitution.
g. The name (s) of the prize winners will be posted on the Comfitex Facebook page.
6. General Terms and Conditions:
Without detracting in any way from the Promotion Rules, the following general provisions shall be applicable to these Rules.
a. The Promoter of the Promotion is NSP Unsgaard (Pty) Ltd, a subsidiary of Lion Match Company (Pty) Ltd, registration number: 2007/028785/07.
b. The Promoters of this Promotion will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time in accordance with the provisions contained in these Rules.
c. By entering and participating in the Promotion, you agree that the Promoters may collect and process your personal information for purposes of this Promotion.
d. The Promoters, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with this Promotion and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this Promotion.
e. In the event of a dispute, the decision of the Promoters will be final and binding and no correspondence will be entered into. In this regard and for further clarity, the Promoters shall be entitled to deal with such disputes (or any failure by entrants to follow the rules) in their sole discretion, including that the Promoters shall be entitled, in addition to any other rights which the Promoters may have in terms of these rules, to immediately disqualify entrants from this Promotion. By entering the Promotion and/or accepting any Reward, the entrants, users and/or winners hereby indemnify, release and hold harmless the Promoters (including their subsidiaries, holding companies and affiliates), their directors, employees, agents, suppliers and contractors (the “Promoters parties”):
i. From and against any actions, claims and/or liability for injury, loss, damage, expense, claim or damages of any kind resulting in whole or in part, directly or indirectly, from participation in the Promotion, and/or the use, acceptance or possession of a Reward, and/or participation (or non-participation) in a Reward-related activity.
f. Entrants who, in the Promoters’ sole determination, act unlawfully, fraudulently, in breach of these Rules or otherwise dishonestly may be disqualified from participating in the Promotion and shall not be eligible to win any Reward.
g. Additional to any other rights contained in the Promotion rules, the Promoters reserve the right to terminate the Promotion at any time with immediate effect. If this is the case, the Promoters will provide a notice on the website and it shall be the responsibility of entrants to review such website in this respect. In such event, all entrants hereby waive any rights, which they may have against any of the organiser parties and acknowledge that they will have no recourse or claim of any nature against the organiser parties.
h. The Promoters are not liable for any technical failure that may result in an entry not being successfully submitted. Any prize is accepted by a winner at his/her own risk and the Promoters are not liable, at any time, for any defect in the prize.
i. The Promoter is not responsible for inaccurate details supplied to any entrant by any third party connected with this competition.
j. The winner/s agree to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner or any other entrants will be used solely in accordance with current South African data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
k. The duration of this Promotion may also be extended or curtailed at the sole discretion of the Promoters. If this is the case, the Promoters will provide notice of this on the Website.
7. Exclusions and other important terms
a. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
b. By entering the Programme in accordance with its terms, Participants acknowledge that the Programme will be managed in accordance with the provisions of the CPA. Qualifying participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the reward
c. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
